Mark I. Pinsky: Trayvon Martin Trial: What to Expect

While handicapping a high-profile criminal trial before it begins is always a chancy undertaking, the outline -- if not the outcome -- is beginning to emerge in the murder prosecution of George Zimmerman for the Feb. 26, 2012, fatal shooting of unarmed black teenager Trayvon Martin.

At a May 28 hearing, Circuit Judge Debra S. Nelson ruled that the trial would begin June 10, and that Zimmerman's attorneys would not be able to raise their leaked information about Martin when questioning prospective jurors. "You can't try the case in jury selection," she said. She also barred any mention of the damaging material in the trial's opening statements.

The information, including Martin's marijuana use, his boasts about fighting and typical, urban teenage, macho posturing, including a text photo of a gun, seemed designed by the defense to lay the groundwork for what might be called the "thug defense." In that narrative, the 17-year-old victim would be portrayed as a menacing figure, slinking around in the darkened, gated community, who attacked Zimmerman -- rather than the other way around.

"Trayvon Martin is not on trial," said Benjamin Crump, the Martin family attorney, after the hearing. Family members want the case, which they believe is a matter of civil rights and equal justice, decided on what is presented inside the courtroom, rather than through selective leaks.

The courtroom, located in a high-rise justice center, was packed, and spectators and media were required to pass through two separate security checks. Members of both the Zimmerman and Martin families sat in the first two rows reserved for them.

In past decades, attorneys for accused rapists would typically engage in character assassination, besmirching the reputation of the victim, a practice that is now largely prohibited. But in the Trayvon Martin case, even if the harmful material is excluded by the judge during the trial (she said Tuesday she was reserving judgement on that issue), it has already become part of the larger narrative that is bound to contaminate the potential jury pool.

This is critical to the fate of the case because, like many criminal trials, the outcome may be determined before the first courtroom argument is made, the first witness called. That is, in the selection of a six-member jury. Given the racially charged nature of the case, it would be extremely difficult to imagine a black juror voting to acquit George Zimmerman of all charges. So an all-white jury would be a major, possibly fatal problem for the prosecution. "That's going to be an issue," Crump acknowledged.

By population, Seminole County is just 10 percent African American, which may or may not be represented in the 500-member pool of potential jurors, which is random.

However, defense attorneys -- with the advice of their highly sophisticated psychological profilers -- need to be extremely careful about the way in which they control the number of black jurors accepted for the panel. They must be particularly judicious in their use of what are called "peremptory challenges" -- those exclusions that can be arbitrary, requiring no explanation. So they are likely to rely on challenging African American -- or liberal white -- candidates for "cause," reasons like prejudice or extensive exposure to pre-trial publicity.

If there is no last-minute plea-bargain, even at this late date, another key factor in the trial's outcome will be Judge Nelson's charge to the jury at the conclusion of the proceedings.

Zimmerman is now charged with second degree murder, which requires proof of intent to kill, and carries with it a maximum sentence of life in prison. However, embedded in the second degree charge, are what are called "lesser included offenses," including voluntary and involuntary manslaughter, which carry a maximum sentence of 15 years. Even a subtle reference to a particular verdict in Nelson's instructions can point the jury toward a certain outcome.

After the hearing, Zimmerman's brother, Robert Zimmerman, Jr., claimed that media and political pressure in the shooting's aftermath was responsible for the second degree murder indictment, which he said was an "improper charge." At least in that respect he may be right.

The Florida state statute describing involuntary manslaughter reads as though it were written to describe the uncontradicted facts of the Trayvon Martin shooting. That is, that the armed Zimmerman, against the advice of a police dispatcher, continued to stalk Martin until an altercation ensued that resulted in Martin's death. A person would be guilty of involuntary manslaughter if he or she acted with "culpable negligence," in a manner that demonstrated a reckless disregard for human life.

Given the defense's theory of the case -- that Zimmerman did not intend to kill Trayvon Martin when he followed him through the teen's father's gated community, and that in fact Martin turned on the neighborhood watch volunteer and attacked him -- a verdict of involuntary manslaughter might provide a conflicted jury an opportunity to arrive at a compromise, "split-the-difference" decision. Involuntary manslaughter is the trial's real battleground.

Latest Technology in Computer Hardware | Computers and ...

The rate at which new computer hardware products are arriving in the market is simply mind-boggling. As the technology advances, the size and the price of the devices come down, while the efficiency and capacity increase. The scenario is same in all cases, whether it is about internal components like processor, motherboard, RAM, graphics card, and hard disk or for peripheral accessories like mouse, keyboard, and monitors. Personal computers became popular only before about three decades back. But already there are huge piles of outdated and antique hardware components and devices. This is a tribute to the tremendous rate of development of latest technologies in computer hardware field. Perhaps, the newest entrant into the archeological catalogue of computer peripherals is CRT monitors. The sleek looking LCD monitors are spreading like computer virus.

Data storage devices have attracted considerable attention of the technology developers. New kinds of storage devices such as newer versions of flash memory cards, hard disks using latest technology and disks of ever-increasing capacity are the results of advancement in latest technology in compute hardware. The memory size of the random access memory (RAM) cards is soaring to enable the smooth functioning of graphics animation software packages and streaming video websites. Also, computer motherboards have undergone substantial changes over the years. More and more functions are being added to the motherboard. Also, despite the incredible improvement in performance and functionalities, the price of these components has actually fallen steadily.

The most vital component of a computer is the microprocessor. It is in this field that a battle of developing latest technologies in computer hardware takes place. The pace of development of microprocessor increases as the competition between the major processor chip manufacturing companies, Intel and AMD, intensifies. Both the companies are engaging in a neck and neck competition and continuously outdo each other in introducing new technologies.

In the field of computer peripherals, the latest technology in computer hardware is in developing yet another version of wireless mouse and keyboard. The concept of wireless mouse and keyboard is about a decade old. But the development of these items is still a work in progress. The latest products of wireless mouse and keyboard are said to be highly durable and error free.

Some of the developments in the latest technology in computer hardware are gearing up for changing the present concept of desktop and laptop computers. With new developments making possible the convergence of mobile phone technology and computers, a new breed of fully functional palm-top computers are going to be introduced in near future. With touch screen monitors and without the need for a mouse, these gadgets are likely to become the next big leap in the constantly leaping technological development field.

Educational Fallacies | Dude, Where's My Freedom?

(Note: ?I originally wrote this piece several months ago, when the Chicago teacher?s strike was ongoing. ?In true slacker/procrastinator fashion, I held off on posting it, because I was going to submit it to a few sites for publication, which I never actually got around to doing. ?Then the strike was resolved, and it wasn?t topical anymore. ?However, I think the main points are still pretty sound, and I don?t really feel like re-writing it, so here?s the original draft, posted for your enjoyment.)

Analysis of the?Chicago teacher?s strike?has re-ignited the ongoing debate about merit pay for teachers, particularly in regards to standardized test scores.? Rather than examine the benefits of merit pay, I?d like to take a minute to discuss some of the logical fallacies that become apparent when this issue is discussed in detail.

Teachers? unions and their apologists (usually those on the left) generally oppose merit-based pay systems, not necessarily in principle, but due to more practical concerns of measurement techniques.? The primary way of measuring ?merit? is by performance on standardized tests.? The unions and apologists will tell you that this measurement technique is faulty.? That it fails to control for socioeconomic conditions.? That standardized tests are biased and not an accurate reflection of the quality of education a student receives.? They paint a picture of a nightmare scenario where normally excellent, kind-hearted teachers will be forced to stop really?educating?their students because, fearing for their jobs, they are now entirely focused on ?teaching to the test? and drilling their students with completely useless knowledge on obscure and archaic topics like reading comprehension and basic math.? A large percentage of the public seems to generally agree with this line of thought, that standardized testing is a poor measurement of teacher performance.

Meanwhile, the message we receive from politicians (from both parties) is that American students are ?falling behind.???This being an election year, we can safely assume that we will be hearing speech after speech decrying the sorry state of American schools, with one candidate suggesting it means we need to spend more money, and the other candidate proposing it means we need some other type of reform.? But neither candidate would suggest that our schools aren?t falling behind.? The rhetoric isn?t limited to election campaigning either.? Feel free to look up any Presidential state of the union address, and you can be assured that at some point, a reference will be made to the declining quality of American schools.??This?rarely disputed narrative,?cited by numerous studies, maintains that the educational quality of American schools continues to fall in comparison to other ?developed? or ?western? nations, and that we are even on the verge of being surpassed by countries such as China or India (perish the thought!)? How exactly do we know this is the case?? How do we arrive at the conclusions such as ?In math literacy, the United States ranks 25th?among OECD countries??? Why, by performance on standardized tests, of course.? How else can we be expected to measure student performance globally?? A large percentage of the public seems to generally agree with this line of thought as well, that standardized testing is a legitimate way to measure the continuing decline of the quality of education in America.

Notice the inconsistency.? The average American tends to believe that standardized testing is a poor way of measuring the performance of individual schools or individual teachers, but is a perfectly legitimate way to measure the performance of nations.? If you suggest that poor test performance indicates a teacher is doing something wrong, you?re being unfair because there are probably a large number of factors outside of the teacher?s control contributing to the results.? Meanwhile, poor test performance?on a national level is clearly an obvious signal that we need to ?invest in the next generation,? (as in, spend more money that we don?t have).? Anyone who suggests that on a national level there may be valid socioeconomic or cultural reasons that our students perform poorly is simply making excuses.? At first glance, this line of thinking may appear to be rational.? After all, at the national level you are dealing with a much larger sample size in which case variables such as economic well-being, local standards and regulations, etc. are likely to average out.? However, simply?comparing nation against nation does not control for these variables.? Statistics such as population size, population density, poverty rates, ethnic diversity, and all the other potential variables in?play?vary wildly across different nations.? Is it fair to compare the United States to South Korea, a much smaller and less diverse society?? Is it fair to compare the United States to China, which is much larger and has much more endemic poverty?? The same objections of unfairness that apply on the micro level apply on the macro level as well.

Eventually, we are going to have to decide.? We cannot continue to cherry-pick, acknowledging test results when we want to demand more funding, and ignoring test results when we want to evaluate teacher performance.? Either standardized testing conveys valuable information about the quality of education students receive, or it doesn?t.

Huge Asteroid Makes Its Closest Pass To Earth Today

Radar images of asteroid 1998 QE2, taken when the cosmic traveler was about 3.75 million miles from Earth, revealed that the asteroid, with a 1.7-mile diameter, has a moon or satellite revolving around it.

Radar images of asteroid 1998 QE2, taken when the cosmic traveler was about 3.75 million miles from Earth, revealed that the asteroid, with a 1.7-mile diameter, has a moon or satellite revolving around it.

NASA/JPL-Caltech/GSSR

An asteroid nine times the size of a cruise ship is dropping by Earth on Friday, and it's not coming alone. Asteroid 1998 QE2 will be about 3.6 million miles from our planet at its closest approach. And its proximity has already given scientists a surprise: The asteroid has its own moon, measured at about 2,000 feet wide.

The fly-by will mark the closest the asteroid comes to Earth for at least the next 200 years, according to researchers at NASA's Jet Propulsion Laboratory who led the radar observations that spotted the asteroid's moon. The point of maximum proximity will come at 4:59 p.m. ET, or 20:59 UTC, Friday, according to the space agency.

"In the near-Earth population, about 16 percent of asteroids that are about 655 feet (200 meters) or larger are binary or triple systems," according to NASA. "Radar images suggest that the main body, or primary, is approximately 1.7 miles (2.7 kilometers) in diameter and has a rotation period of less than four hours."

Unless you can access a powerful telescope, you won't be able to see the asteroid, much less its lunar tagalong ? 1998 QE2 will pass no closer than 15 times the distance between the Earth and its moon. You can watch live video of the asteroid's passage at Space.com, where a webcast will feature video from the Slooh Space Telescope and the Virtual Telescope Project.

NASA TV hosted a special video on the asteroid Thursday; the agency also recommends the hashtag #asteroidQE2 for those wanting to share thoughts about the asteroid on Twitter.

For amateur astronomers, NASA recommends trying to view the asteroid in the first week of June ? particularly June 3 and 4 ? when its sunlit side will face the Earth. As for the appearance of 1998 QE2, NASA says it reflects only 6 percent of the light that hits it, making it blacker than coal.

In stories earlier this month announcing the approach, NASA seemed as though it was trying to ease alarmist fears of a cosmic calamity, predicting that the asteroid "will sail serenely past Earth."

In February, news that a smaller asteroid ? 2012 DA14 ? was passing by Earth caused a surge of interest, particularly as it came on the heels of a meteor that exploded as it streaked across the sky in Russia.

The 1998 QE2 asteroid was discovered less than 15 years ago, by the Massachusetts Institute of Technology Lincoln Near Earth Asteroid Research (LINEAR) program in New Mexico. The asteroid has not yet been formally named ? its current designation reflects a naming convention stemming from its discovery.

While 1998 QE2 has been deemed safe, NASA says it's keeping an eye out for any possible threats to Earth posed by asteroids. In addition to developing plans to deflect or even possibly 'shrink-wrap' an asteroid, the agency is planning a mission to study another asteroid in the coming years.

"In 2016, NASA will launch a robotic probe to one of the most potentially hazardous of the known Near-Earth Objects," the agency says. "The OSIRIS-REx mission to asteroid (101955) Bennu will be a pathfinder for future spacecraft designed to perform reconnaissance on any newly-discovered threatening objects."
